These Terms & Conditions ("Terms") govern your use of thedarkhorseadvisory.com (the "Site"), operated by The Dark Horse Advisory, LLC, doing business as The Dark Horse Advisory ("Dark Horse," "we," "us," or "our"), based in Middleton, Idaho. By using this Site, you agree to these Terms. If you do not agree, please do not use the Site.

This Site describes Dark Horse's professional services, including workshops, diagnostics, and advisory engagements for leadership teams. The Site is informational. It is not an offer, contract, or commitment to provide services. All engagements are governed by a separate written agreement.

To the fullest extent permitted by law, The Dark Horse Advisory, LLC, The Dark Horse Advisory, Christy Slanaker, and any contributors shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of, or inability to use, this Site or its content, even if advised of the possibility of such damages.
Total aggregate liability for any claim related to the Site shall not exceed one hundred US dollars ($100). Liability for any signed engagement is governed by the limitation of liability clause in the relevant engagement letter or master services agreement, not by these Terms.
Some jurisdictions do not allow exclusion or limitation of certain damages, so portions of this section may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless The Dark Horse Advisory, LLC, The Dark Horse Advisory, Christy Slanaker, and any affiliated parties from any claim, damage, loss, liability, cost, or expense (including reasonable attorney fees) arising out of your use of the Site, your violation of these Terms, or your violation of any right of another party.

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
16. Entire Agreement
These Terms, together with the Privacy Policy, Accessibility Statement, and AI Disclosure, constitute the entire agreement between you and The Dark Horse Advisory, LLC regarding your use of the Site. Engagement work is governed by separate written agreements.
